ENS and EXS. Entry and Exit Summary Declarations - Mandatory from 1st January 2011

In accordance with the Commission Regulation (EC) No 648/2005 of the European Community, economic operators (persons involved in activities covered by customs legislation) are obliged to lodge pre-arrival or pre-departure information with the customs authorities in advance. Based on these summary declarations security and safety risk analyses can be performed to help identify high-risk shipments well in advance and handle them accordingly.

Originally the implementation of the entry (ENS) and exit summary declaration (EXS) was planned for 1 July 2009 together with the implementation of the obligatory electronic exit summary declaration (AES 2.0). A transitional period has however been granted, and the introduction has been postponed to 31 December 2010. During this transitional period, entry and exit summary declarations can be submitted on a voluntary basis in as far as customs systems allow for it. From 1st January 2011, it will be mandatory to submit the ENS and EXS electronically.

The entry summary declaration forms part of the European Import Control System (ICS) and represents the first milestone within the framework of the planned Automated Import System (AIS). The introduction of ENS will enable harmonised risk analyses to be performed at a European level based on data processing techniques using common criteria, thus allowing goods to be processed and cleared faster upon arrival.

The challenge, however, is that all EU member states have their own interfaces. Therefore exists a total of 27 different software solutions, one in each country of European Union.
